Alcoholic Beverage Control: Enforcement Techniques for Law Enforcement
Course Overview

This two-day course will assist municipal police officers who are assigned Alcoholic Beverage Control administrative investigations and/or are responsible for background investigations for the municipal issuing authority alcoholic beverage licensing process, with a working knowledge of the law, applicable administrative regulations and current investigative techniques. Participants will "walk through" a licensing background investigation to determine what is required by the municipal issuing authority and the investigative techniques that can be employed. Problems the issuing authority may encounter with a licensee during annual license renewal process or a disciplinary hearing will be discussed. Also covered are suggested strategies for appeals to the Division of Alcoholic Beverage Control and emergent hearings for stays or extension of the license and procedures to sell alcoholic beverages. All participants will receive extensive course materials, including applicable laws, administrative regulations, case law, ABC forms, and manuals.

The Division of Alcoholic Beverage Control's (NJABC) Enforcement and Investigations Bureau will conduct a one day course on the tools available to Local Issuing Authoriies in the regulation of a municipality's alcoholic beverage control licenses. Specific topics include:
  • N.J.A.C. 13:2-23.1 et.seq., The NJABC retail enforcement regulations, including underage drinking, intoxicated patrons, after-hour sales, narcotics activities, lewd activities, gambling, among others to be discussed. The discussion will include the elements of each offense and a recommended investigation strategy for building an administrative case against the license.

  •  Undisclosed Interest Investigations. A discussion of the elements of an undisclosed interest and how to gather information concerning the business that, in totality, prove an undisclosed interest or "lease-out" of a license.
  • Special permits, including, Social Affairs, Expansion of Premise and Catering. A discussion of who can use these permits, what they can, and cannot be used for, and the Police Department's responsibility for review and recommendations for conditions.

Prerequisite for attendance at this course - Prior attendance at the NJABC two-day Law Enforcement Techniques Course.
